Is it theft to place an image tag to an image on another persons server that displays that person image on your own website even though you have not downloaded it from that persons server to your own server?
Surely this is not theft but linking, so no breach of copywrite has been made as you havn't copied anything ?

Tricky one that, as technically you can be considered to be either: 1) Using their image for your own gain (especially if for a commercial purpose) 2) Damaging their business (Mattsnapper could probably fill you in on that one!), especially if you are using the image for a humorous purpose, or anti-whoever campaign/statement. Also, as you are drawing down their image, you are also making use of their server and bandwidth, therefore incurring them costs. I was very nearly sued for a spoof website i made a few years ago, as some of the graphics i used were "remarkably similar" to those used on the genuine site. Not even pictures, just borders, buttons etc. I was lucky to cut a deal whereby i removed it all, handed them the domain name, end of. IMHO, the best advice is NOT to create an image tag or copy the image to your website AT ALL WITHOUT PRIOR PERMISSION!!! Best thing to do is just provide a basic hyperlink to their site/the image, as this way you're not stealing anything, and are actually directing people to their site. However, I know for a fact that Ticketmaster tried to sue people for this (known as " deep linking") , because they said that by avoiding their frontpage they were causing them to lose custom. Cant remember the outcome offhand, but i think the whole internet community laughed them out of court for that one. BE CAREFUL, and DON'T SAY I DIDN'T WARN YOU!!!!

but----if the copywrite covers any unauthorised use, or something like that, then the link via image tag could be construed to be a breach of the copywrite

Oh just one slight modification: JP_Shrew has license to post as many fit babes as he likes If he gets sued, we can all chip in to Free the Shrewsbury One!

i think it is officially and if the owner of the pic complains then its wise to stop linking to it until then it no worse than pretending you are d beckam when taking a free kick
