Has anybody on here had to deal with this bunch of charlatans?
I sold my car last year (August 2014) to a reputable car dealership and completed all relevant documentation which was sent to DVLA. The car had road tax on it until 28/2/15. - a full six months. Everything was great until Feb this year when I received a letter reminding me that my road tax is due to a car I no longer own. Despite phoning and writing to them to explain I do not own the car, I kept getting reminders. This has now been followed by several debt collecting letters demanding I pay £80. The dvla have told me I have to pay it, despite them telling me on the phone that the new owners have paid road tax on the car.

Okay, well you should have done if the papers had been received because you can't transfer tax any more, has to be refunded to registered/previous keeper. Have you filled anything in to say that you didn't send off the notification yourself (ie left it in the hands of the garage?) If you have then you're a bit f***ed I'm afraid. The legal advice here is worth reading, but be warned, the DVLA doesn't automatically refer cases to court if you don't pay up, they go to debt collectors. Do you still have the cheque details received from the dealer and copies of the documents you sent to DVLA?

Cheque details won't make any odds, they're not disputing the car has been sold, they're saying they weren't notified and the keeper remains responsible for ensuring the vehicle is continuously taxed until such time as they do.

is the car back on the road with a new owner ?
you can do a tax check on many sites
if so there is your evidence that someone else is running 'your car'
failing that, go along with them and get them to send you a replacement log book
when i comes go find your car and reclaim it

but if taxed it will show when it runs out, which could possibly be around now which would mean its been taxed for last 6 months

He's received the penalty because there's been a gap in licensing and he was the registered keeper at the time that gap occurred.
If the tax ran out at the end of September, that would mean it was taken out in April leaving March unaccounted for.
If it was taxed in March he wouldn't have had the letter...although he could still have ended up with a fine for failing to notify disposal, and potentially still could.
